CruiseDividends Terms and Conditions

In order to participate and receive benefits from the CruiseDividends program you must agree to these CruiseDividends terms and conditions, 02Cruise.com dba GoDifferent LLC (hereinafter "GoDifferent") terms and conditions, terms and conditions of any third party involved in the fulfillment of the CruiseDividends program, and the terms and conditions of any cruise line with whom you request booking by GoDifferent (for award travel or otherwise). GoDifferent may change the CruiseDividends terms and conditions at any time, or terminate the program altogether, without notice and without compensation to participants, even though such changes may affect the value of points already accumulated. The rules in effect at the time you request a CruiseDividends benefit will govern that transaction. Award certificates have no cash value and will not be refunded. Standard GoDifferent and cruise line change fees apply to changes made to award travel bookings. You are responsible for paying all applicable taxes, fees and surcharges (including sales, value added, Customs, inspection, security, agriculture and departure charges) and obtaining necessary travel documents for award travel.

Void Where Prohibited By Law

Some or all parts of the CruiseDividends program may not be legal in certain jurisdictions, and CruiseDividends is void where prohibited by law.

Eligibility

CruiseDividends is open to any individual person living within a United States state who is 18 years of age or older, subject to all other requirements herein. Only one person may be enrolled per CruiseDividends account, and members may not maintain more than one CruiseDividends account. GoDifferent may disallow any individual from participating in the CruiseDividends program for any reason. A valid email address is required for membership in CruiseDividends.

Personal Information

Members are responsible for advising GoDifferent of any change of name or email address on their account. With a CruiseDividends login ID (email address) and chosen password members have access to their CruiseDividends information online. Establishment of a CruiseDividends password indicates acceptance of the terms and conditions herein. Passwords cannot be viewed or changed by GoDifferent. Resetting a password can be done online at 02Cruise.com.

It is your responsibility to maintain the security of your email account and to select and maintain a secure CruiseDividends password. You are responsible for any actions taken with your CruiseDividends number and password, including but not limited to any transactions in your account. GoDifferent has no liability for losses resulting from unauthorized access to, or use of, your password. In the event of apparent discrepancies or policy violations, GoDifferent may delay the processing of CruiseDividends awards until the issues are resolved.

Points Credit

CruiseDividends points may accrue only to the account of the CruiseDividends member who earns the points, for cruises actually sailed. The number of points available for award on a given booking will be awarded in full to only one CruiseDividends account holder on that booking, at the discretion of the person whose credit card is used to pay for the booking. Points will be "pending" and not available for redemption until sailing actually occurs. The number of points earned for a cruise once booked may increase, decrease, or be eliminated, in the event of changes in price, promotion or other changes to the booking. CruiseDividends points are currently available only in conjunction with most (but not all) cruise bookings on Royal Caribbean and Celebrity Cruises whose cruise-only cost is more than about $400 per person, double occupancy (including all cruise-related taxes and fees, excluding any non-cruise charges such as but not limited to: airfare, transfers, hotel stays, travel protection, pre- or post-cruise tours, and taxes/fees associated with such non-cruise items). CruiseDividends award points may not accrue in conjunction with certain promotions or discounts. GoDifferent is the final authority on qualification for points accrual and reserves the right to deny or revoke mileage credit at any time if GoDifferent determines that points were given wrongly. You may request credit for past, eligible transactions up to 3 months from the transaction date. Cruises booked prior to your enrollment date or prior to the CruiseDividends program start date of 15-September-2004 are not eligible for credit.

Account Expiration

Accounts with no activity (points earned or applied) for 18 consecutive months may be deleted and accrued points forfeited.

Termination and/or Point Deduction for Violations

GoDifferent reserves the right to terminate your membership in CruiseDividends at any time if you violate the CruiseDividends program rules, any term or condition of GoDifferent, or any other GoDifferent or cruise line rules and regulations. Termination of your membership will result in a loss of all accumulated points, the cancellation of any unused awards or award certificates, and the loss of all other CruiseDividends benefits. Terminated members are not eligible to participate in any aspect of the CruiseDividends program. GoDifferent may alternatively, at its sole discretion, deduct points from your account, but permit you to continue participating in the CruiseDividends program.

Awards

The available awards, merchandise and other benefits available under the CruiseDividends program are updated constantly. Awards available at the time you book your cruise may not be available at the time you are eligible to redeem your CruiseDividends points.

Program Changes and Termination

GoDifferent reserves the right to change any aspect of the program, including award levels and requirements, at any time without notice. For example, this means that GoDifferent could change without limitation partner affiliations, merchandise availability, rules for earning point credit, award cost or selection, or availability dates. GoDifferent reserves the right to terminate the CruiseDividends program without notice. Unless otherwise stated, the terms and conditions of the CruiseDividends membership guide and program rules in effect at the time of any award redemption, request for a benefit, or other transaction, will govern the transaction.

Controversies

If GoDifferent denies a member point credit, award, or some other benefit incorrectly, the sole remedy shall be the award of the disputed point credit, or benefit if available, or alternative comparable benefit selected by GoDifferent, which shall have no additional liability whatsoever. In no event shall GoDifferent be liable in regards to the CruiseDividends program to anyone for any direct, indirect or consequential damages, or lost revenue or profits, arising out of GoDifferent acts or omissions. The CruiseDividends program shall be governed by and construed in accordance with the laws of the state of New Hampshire, and controversies shall be resolved by any U.S. federal or state court located in the state of New Hampshire.

Sale or Barter Prohibited

The sale or barter of CruiseDividends points, or awards is prohibited. Awards obtained through violation of this, or any other of the terms and conditions, are VOID. CruiseDividends points are not transferable and may not be combined among CruiseDividends members, their estates, successors and assigns. Accrued points do not constitute property of the member. Neither accrued points, nor awards, are transferable by the member upon death, divorce, or by other operation of law.
